2. Scope of These Terms
These Terms and Conditions apply to all clients and prospective clients who engage with Thida Niti, whether through our website, by telephone, in person, or by any other means. They govern the use of our website and any service engagement.
Specific engagement terms for individual service instructions will be set out in a Client Engagement Letter. In the event of any conflict between these Terms and a Client Engagement Letter, the Client Engagement Letter shall take precedence in relation to that instruction.
3. Our Services
We offer three structured services for pension matters. Each is described on our website and in the relevant engagement documentation. The services are:
Pension Overview Consultation
A structured initial meeting to review your pension position, explain available options in plain terms, and answer your questions. A written summary of the discussion is provided. Fee: ฿4,200.
Claim Preparation Support
Practical assistance in preparing and organising a pension claim or formal response, including document gathering and correspondence drafting. Fee: ฿9,800.
Comprehensive Pension Representation
Full representation through a pension dispute or appeal, with complete case management and a clear outline of costs before each phase. Fee: ฿17,300 (base, further detail provided in engagement documentation).
All fees are stated in Thai Baht (THB) and are exclusive of any applicable taxes or third-party disbursements unless otherwise specified in writing. Fees are reviewed periodically; the current fee schedule will be confirmed prior to engagement.
4. Client Engagement
An engagement with Thida Niti begins only when both parties have agreed in writing to the scope of work and fees. Submitting an enquiry through our website or making initial contact does not itself constitute an engagement.
Before work begins, we will issue a Client Engagement Letter setting out the specific service, the agreed fee, and any relevant conditions. Work will proceed only upon your confirmation of that letter.
We reserve the right to decline any engagement where a conflict of interest arises, where a matter falls outside our practice area, or where we have reason to believe we cannot act effectively in your interest.
5. Client Obligations
To enable us to act effectively, clients agree to:
- Provide accurate and complete information relevant to their matter
- Inform us promptly of any material changes to their situation
- Respond to requests for information or documents in a timely manner
- Pay agreed fees in accordance with the terms of their Client Engagement Letter
- Not act in a way that conflicts with our professional obligations or instructions from any relevant authority
We cannot be held responsible for delays or adverse outcomes arising from incomplete or inaccurate information provided by the client, or from failure to respond within agreed timeframes.
6. Fees and Payment
Fees for each service are confirmed in the Client Engagement Letter before work commences. For multi-phase matters, costs for each phase are outlined and agreed before that phase begins.
Payment terms will be specified in the Client Engagement Letter. Where a deposit is required, work will begin only upon receipt of that deposit. Outstanding balances are payable within the period stated in the engagement documentation.
Disbursements (court fees, third-party charges, official document costs, and similar expenses) will be identified in advance wherever possible and agreed with the client before being incurred. They are billed separately from our professional fees.
7. Confidentiality
We treat all client information as strictly confidential. Information shared with us in connection with your matter will not be disclosed to third parties without your consent, except where disclosure is required by law, court order, or the rules of our profession.
Our confidentiality obligations continue after an engagement ends. Our data handling practices are set out in the Privacy Policy.
8. Limitation of Liability
Our liability to clients arises only from our direct professional conduct. We are not liable for outcomes that depend on decisions made by third parties, regulatory bodies, courts, or pension fund administrators.
Our aggregate liability in connection with any single engagement shall not exceed the fees paid by the client for that engagement, unless the liability arises from our gross negligence or wilful misconduct.
Nothing in these Terms limits our liability for fraud, personal injury caused by our negligence, or any liability that cannot be excluded under applicable Thai law.
9. Intellectual Property
All content on this website — including text, structure, design, and documentation — is the property of Thida Niti or its content providers and is protected by applicable copyright law. You may not reproduce, redistribute, or commercially exploit any part of this website without our prior written consent.
Documents we prepare for you as part of an engagement are provided for your personal and legal use. They may not be shared with third parties for purposes other than your matter without our consent.
10. Use of This Website
This website is intended to provide general information about our services. Nothing on this website constitutes legal advice. If you have a specific legal matter, please contact us directly.
We aim to keep the information on this website accurate and current. However, we make no representations about its completeness or accuracy, and we are not liable for any reliance placed on it.
We reserve the right to change, suspend, or withdraw any part of this website at any time without notice.
11. Links to Third-Party Sites
Our website may include links to external sites — including government agencies, social security institutions, and other relevant bodies — for your convenience. We do not control or endorse the content of those sites and are not responsible for their availability or accuracy. Visiting a linked site is at your own discretion.
12. Ending an Engagement
Either party may end an engagement by giving reasonable written notice. In that event, you will be responsible for fees in respect of work completed up to the date of termination, as well as any disbursements already incurred.
We may end an engagement without notice if you act in a way that prevents us from carrying out our professional obligations, if payment obligations are not met after reasonable notice, or if circumstances arise that create a conflict of interest.
13. Governing Law and Jurisdiction
These Terms and any engagement with Thida Niti are governed by the laws of Thailand. Any dispute arising in connection with these Terms or our services will be subject to the jurisdiction of the courts of Thailand, with Phuket as the preferred venue unless otherwise agreed in writing.
14. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on this website, with the effective date noted at the top. If you are an existing client, material changes will be communicated directly. Continued engagement with Thida Niti following a change constitutes acceptance of the revised Terms.
Questions About These Terms
If you have questions about anything in these Terms before engaging our services, please reach out. We would rather you ask first than proceed with any uncertainty.
